On September 8, the Supreme Court voted six to three to overturn the order that had blocked Immigration and Customs Enforcement (ICE) from racially profiling people when detaining them. ICE is now allowed to judge people’s immigration status based on where they are at the time, race, place of work and even what language they speak.
ICE can now stop anyone and detain them if they think they are an illegal immigrant. There are cases where ICE takes people in front of their kids and leaves them there. There was body cam footage of ICE detaining a father taking his daughter to work, and they broke through his window to grab him. He was then arrested and taken into custody.
The increase in ICE power is a part of Donald Trump’s “Big Beautiful Bill.” During Trump’s campaign, he said he would crack down on immigration. Critics say these ICE raids break the Fourth Amendment, which clearly states that “the right of the people to be secure in their persons, houses, papers and effects, against unreasonable searches and seizures.” The right for people to be secure and exempt from unreasonable searches and seizures is the main part of the amendment as stated by ConstotutionAnnotated.gov.
